When does the 30-day period start?

For an ordinary UK data protection complaint within the supported rule set, the organisation must acknowledge receipt within 30 days. The period starts on the day after receipt.

What if day 30 is not a working day?

If the 30th calendar day falls on a weekend or relevant public holiday, the acknowledgement deadline moves to the next working day.

Is day 30 the final response deadline?

No. It is the acknowledgement deadline, not a fixed final-response deadline. The organisation should begin investigating when it receives the complaint and proceed without undue delay.

What must the complaint record contain?

The ICO recommends keeping the receipt date, acknowledgement, relevant conversations and documents, the outcome, and actions taken as a result of the investigation.

What if the message also includes a rights request?

Keep the complaint and data rights request as separate records with separate clocks. A complaint does not automatically replace or pause the response period for a subject access or other rights request.
